Legal
Terms of Use
These terms cover the Selfworth app for Android. If you use Selfworth on an iPhone, Apple's standard Licensed Application End User License Agreement applies instead. Diese Bedingungen auf Deutsch.
1. Who provides Selfworth
Piet Gehrke, trading as “Gehrke Studio”Wandsbeker Schützenhof 24, 22047 Hamburg, Germany
piet@gehrkestudio.com
Full legal details are in the Impressum. In these terms, “we” means the provider named above, and “you” means the person using the app.
2. What Selfworth is, and what it is not
Selfworth is a journal for building self-worth, based on published methods from cognitive behavioural therapy and self-compassion research. It is a self-help tool. It is not a medical device, it does not diagnose or treat any condition, and it does not replace care from a doctor, therapist or other professional.
Selfworth is not made for emergencies. If you are in crisis or thinking about harming yourself, please contact someone who can help right now: in Germany, Telefonseelsorge on 0800 111 0 111 or 0800 111 0 222; in the US, call or text 988; elsewhere, your local emergency number.
3. Your right to use the app
You may install Selfworth and use it for your own personal, non-commercial purposes. You may not copy, sell, rent out or redistribute the app, or reverse-engineer it except where the law allows you to. All rights in the app, its texts and its design remain with us.
What you write in Selfworth belongs to you. We never receive it (see section 6).
4. What stays free
Without any purchase and without a time limit, the app includes the free floor: among other things, the daily check-in with one line of evidence every day, the whole compassion break, and everything you have ever written, which stays readable. Your first session in the app, the test you plan in it and the follow-up on that test are also free. The rest of the app, which the app calls the full app, requires one of the purchases in section 5. The paywall in the app lists what each includes before you buy.
We may change what the free floor includes in future versions, but we will never make anything you have written unreadable.
5. Purchases through Google Play
The full app is available as:
- a monthly subscription and a yearly subscription, which renew automatically at the end of each period until you cancel;
- a one-time purchase (lifetime), which is paid once, never renews, and unlocks the full app for as long as the app is offered for Android, on the Google account you bought it with.
Free trial: if your Google account is eligible, the monthly and yearly subscriptions start with a free trial of 14 days. Starting a free trial means taking out the subscription: Google Play asks for a payment method, nothing is charged when the trial starts, and when it ends the subscription renews automatically and the price shown is charged, unless you cancel before the trial ends. The one-time purchase has no free trial.
The current prices are shown in the app and in Google Play before you buy, including any taxes that apply where you live. All payments are processed by Google through Google Play; we never see your payment details. The Google Play Terms of Service apply to the purchase itself.
Cancelling a subscription: you can cancel at any time in the Google Play app under Payments & subscriptions, or from the You tab in Selfworth, which opens that page. A cancellation takes effect at the end of the current period, whether that is a free trial or a period you have paid for; until then the full app stays unlocked. If you cancel before a free trial ends, the subscription does not renew and you are not charged for it. Deleting the app does not cancel a subscription.
Refunds are handled by Google under Google Play's refund policies. Your statutory rights as a consumer, including any right of withdrawal that applies to you, are not affected by these terms.
Price changes for subscriptions are announced by Google Play in advance, following Google's rules. Where those rules require your agreement, a higher price only applies once you have agreed to it.
If you change phones or reinstall, you can restore your purchase with “Restore purchases” in the app, using the same Google account.
6. Your journal and your data
Your journal is stored on your device. There is no Selfworth account and no Selfworth server, and we cannot see, recover or delete what you write. If you turn on the backup in the app, a copy goes into your own Android backup, which we cannot see either. Details are in the Privacy Policy.
Because only you hold your journal, keeping it safe is in your hands. If you lose or reset your device without a backup, we have no way to bring your entries back.
7. Updates and availability
We improve Selfworth through updates, which may change or remove individual features. Paid features you have access to will not be removed without offering something comparable, unless we are legally required to. We aim to keep the app working on current Android versions, but we cannot promise that it will run on every device or be available without interruption.
8. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only if we breach an obligation that is essential to using the app as intended and that you may rely on, and then only for damage that is typical and foreseeable for this kind of app. Otherwise our liability is excluded. These limits also apply to the people who work for us.
9. Changes to these terms
If we change these terms, we will publish the new version on this page with a new date. Changes never take away rights you have already paid for. If a change affects you significantly, we will tell you before it applies, for example in the notes of the app update that brings it.
10. Law and disputes
German law applies. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If something goes wrong, please write to us first: piet@gehrkestudio.com.
These terms are available in English and German. If the two versions differ, the German version applies.
